FAMILY REUNIFICATION, 

 MARRIAGE VISA

       The spouse and the family members  of Hungarian citizens can apply for family reunification. However, this kind of application is often rejected. Due to   the big numbers of the  marriage of convenience the Authorities scrutinize this type of application thoroughly.

There are plenty of delusions and misbeliefs on family reunification visa and marriage visa. Lots of applications are rejected because of the errors. Always consult with some expert  before you submit your application.

MISTAKES, DELUSIONS AND MISBELIEFS

   

   1.  "AFTER THE MARRIAGE THE SPOUSE AUTOMATICALLY WILL GET A VISA...."       

                                  

 

    The most common misbelief. If the applicant cannot meet the criteria of the residence permit his or her application will be rejected. 

Which are the basic criteria of a successful application:

A. Proofing financial sufficiency 

​

The applicant has to have enough money or income to  cover the costs of his or her life in Hungary. At least 200,000 HUF income or 3-4 million HUF saving is needed. 

Lots of applications are rejected because the applicant thought that he or she would cover the expenses by working in Hungary. This case however you have to

apply for Residence Permit for the Purpose of Employment. 

A family member can support the applicant in Hungary, but in this case his solvency will be checked.

B. Proofing the Accommodation 

 

It could be verified by rent contract, real estate purchase contract or a contract on accommodation by courtesy

​

C. Health Insurance

 

The health services  of the applicant has to be covered. The health insurance policy has to cover expenses up to 30,000 euros, the sum depending on the residing days, and also it has to be valid in all Schengen countries. The health insurance policy must be purchased before picking up the visa and if your visa is refused you can cancel it!

2.  "AFTER THE MARRIAGE EVERYBODY CAN SUBMIT THE APPLICATION IN HUNGARY.....  

 

Only those can apply in Hungary who  legally entitled.

  3.  "WE WILL WORK IN GERMANY (AUSTRIA, GREAT BRITAIN,  ETC) WE JUST APPLY  BECAUSE MY HUNGARIAN IS SPOUSE..."

If somebody wants to live and work outside of Hungary he or she has to apply for residency in that very country. It does not matter what your spouse's citizenship is.

 4.  "NOT USING THE RIGHT VISA APPLICATION FORM .."  

 

Family reunification is one of the most complicated parts of the immigration law. It is difficult to find out whether someone has to apply for Residence Permit for the Purpose of Family Reunification, Residence Card for Third-country National Family Member of Hungarian Citizen, Residence Card for Third-country National Family Member of EEA Citizen. Always check whether you apply with the correct application form.
